Is it allowed to drive a car if you use CBD?

Is it allowed to drive after using CBD oil? In this blog, you will read what science says, how legislation differs by country, and what to watch out for to use it safely on the road.

Mag je autorijden als je CBD gebruikt?
Part

Yes, in most cases you may drive after using CBD oil, provided the product contains no noticeable amount of THC. CBD is not mind-altering and normally does not affect your driving ability. However, it is important that your product is legal, has a pure test report, and contains no other substances that could affect driving.

Does CBD affect your driving ability?

CBD (cannabidiol) acts on the endocannabinoid system, which regulates your mood and stress response among other things. It has no psychoactive effect like THC and does not directly affect your reaction time, motor skills, or judgment.

Research published in the journal Addiction (2025) showed that test subjects did not show deterioration in their driving performance after using CBD compared to a placebo. Also a study from Trends in Sport Sciences (2021) concluded that reaction time was not affected.

However, CBD in higher doses can cause fatigue in some people. Therefore, always start with a low dose, especially if you are not yet familiar with its effects.

Are you tested positive in a saliva test?

CBD itself does not give a positive result in a police saliva or urine test. These tests are aimed at THC, the psychoactive substance in cannabis. But if your CBD product contains traces of THC, this can under certain circumstances lead to a false positive result.

Therefore, always choose a CBD oil that:

  • Broad-spectrum or isolate is (without THC)

  • Test reports that can demonstrate the THC content (e.g., < 0.05%)

  • Taken sufficiently in advance (at least 1–2 hours)

This minimizes any risk during traffic checks.

What does the law say in the Netherlands?

In the Netherlands, CBD is legal as long as the product contains less than 0.05% THC. This threshold prevents the product from being classified as a ‘narcotic’ under the Opium Act. The police focus on substances that affect driving ability during traffic checks, such as alcohol or THC.

CBD is therefore not included. If you use a pure product without measurable THC, you are not at risk in a saliva or blood test. However, the law remains strict on ‘influence’ in traffic. If you feel tired or not alert, you can still be fined.

What does the law say in Belgium?

In Belgium, CBD is allowed as long as the product contains less than 0.2% THC. This limit aligns with the European directive for hemp products. However, the legal situation remains unclear: there is no explicit law regulating CBD use in traffic.

The police can take action if your driving behavior is abnormal, regardless of the cause. If you use a product containing traces of THC, a positive saliva test can still lead to an investigation. Therefore, caution is also advised in Belgium when using CBD before driving.

What does the law say in Germany?

Germany allows CBD products as long as the THC content remains below 0.2%. This follows the European standard. In theory, you can safely drive with CBD as long as the product is pure and you do not ingest noticeable THC.

German police can perform saliva tests during traffic checks. These primarily target THC. Because Germany is strict on traffic safety, experts recommend using THC-free products (e.g., CBD isolate or broad-spectrum) if you drive regularly.

What does the law say in Europe?

Within Europe, there is no uniform regulation for CBD in traffic. Most countries follow the EU directive that allows CBD as long as the THC content remains below 0.2%. However, there are local differences in interpretation and enforcement:

Country

Belgium

0,2%

Yes, but a gray area

France

Switzerland

Austria

Beware of products without claims

Always check the THC content and when traveling through Europe, choose a product with a test report and without psychoactive substances.

In which situations should you be careful?

Although CBD is basically safe for traffic, there are circumstances where you should be cautious:

  • Fatigue: High doses can cause drowsiness

  • Impure products: Some CBD oils contain residual THC, even at 'legal' percentages

  • Combination with other substances: Alcohol, medications, or supplements can enhance the effects

  • Inexperienced use: First time using CBD? Then do not drive immediately after intake

Do you use CBD daily and depend on your car? Then choose a product without detectable THC and test its effects at home first.

How to choose a ‘traffic-safe’ CBD oil?

Not all CBD oils are suitable for use when driving. Therefore, pay attention to the following points:

  • Broad-spectrum or isolate – contains no or hardly any THC

  • Current test report – check for < 0.05% THC (see test reports)

  • Transparent ingredient list – avoid products with added substances that cause drowsiness

  • Clear dosing instructions – start low, increase only if effective

At Prohemp you will find CBD oil with reliable lab analyses and clear compositions. This way, you can use CBD with peace of mind and drive safely.

Are you allowed to drive with CBD oil in Belgium or Germany?

Yes, you are allowed to drive with CBD oil in both Belgium and Germany, as long as the product is legal and the THC content remains below the local limit (0.2%). However, be aware that traces of THC can lead to checks. Preferably use a THC-free CBD oil.
